Following tradition, during this year’s Assembly of States Parties meeting, the out-going International Criminal Court prosecutor Fatou Bensouda, delivered her annual report on Preliminary Examinations. That’s the bit even before investigations, well before a trial. There’s a lot of discussion about whether the ‘PE’ stage is really working. And this year, her decision to say no to launching an investigation into alleged crimes by British servicemen in Iraq attracted a lot of discussion.
